1. General Provisions

1.1. These Terms of Service (hereinafter “Terms”) define the rules and conditions for using the Describelio service (hereinafter “Service”), available at describelio.com.

1.2. The Service Provider is Bellita Mariusz Nowakowski, with its registered office at Os. Królewska 18/U7, 02-972 Warszawa, Poland, NIP: PL5661842922 (hereinafter “Service Provider”).

1.3. By registering an account or using the Service, the User accepts these Terms in their entirety. If the User does not agree with any provision of these Terms, the User should not use the Service.

1.4. The Service Provider reserves the right to amend these Terms. Users will be notified of any changes via email at least 14 days before the new Terms take effect.

2. Definitions

2.1. Service — the Describelio web application available at describelio.com, providing AI-powered product description refresh for e-commerce stores.

2.2. User — any natural person, legal entity, or organizational unit without legal personality that uses the Service.

2.3. Account — a personal account created by the User upon registration, providing access to the Service’s features.

2.4. Subscription — a paid plan (Pro or Max) granting the User access to additional features and higher product refresh quotas.

2.5. Content — product descriptions generated or refreshed by the Service using artificial intelligence.

2.6. Platform — an e-commerce platform (Magento 2, PrestaShop, Shopify, or Shoper) integrated with the Service.

2.7. Refresh — the process of generating a new, SEO-optimized product description using AI and publishing it to the User’s e-commerce store.

3. Account Registration and Use

3.1. To use the Service, the User must create an Account by providing a valid email address and password.

3.2. The User is responsible for maintaining the confidentiality of their Account credentials and for all activities conducted under their Account.

3.3. The User agrees to provide accurate and current information during registration and to update such information as necessary.

3.4. The Service Provider reserves the right to suspend or terminate an Account that violates these Terms or is used for unlawful purposes.

3.5. Each User may maintain only one Account. Creating multiple accounts to circumvent usage limits is prohibited.

4. Service Description

4.1. Describelio is a SaaS (Software as a Service) application that automatically refreshes product descriptions in connected e-commerce stores using artificial intelligence (GPT-based models).

4.2. The Service supports integration with the following platforms: Magento 2, PrestaShop, Shopify, and Shoper.

4.3. The Service preserves all media elements (images, videos, embedded content, and links) present in the original product descriptions during the refresh process.

4.4. The Service offers automatic scheduling of product description refreshes on Pro and Max plans, cycling through all connected products on a rolling basis.

4.5. The Service may integrate with Google Search Console to request re-indexing of refreshed product pages.

5. Subscription Plans and Payments

5.1. The Service offers the following subscription plans:

  • Free — 5 product refreshes per month, manual refresh only.
  • Pro — 30 product refreshes per month, automatic scheduling included.
  • Max — 100 product refreshes per month, automatic scheduling included.

5.2. All prices are displayed as net amounts. Value Added Tax (VAT) is calculated automatically at checkout based on the User’s location, in accordance with applicable EU VAT regulations.

5.3. Payments are processed securely through Stripe. The Service Provider does not store payment card details.

5.4. Subscriptions are billed monthly. The User may upgrade, downgrade, or cancel their subscription at any time from the dashboard. Changes take effect immediately, and unused time is prorated.

5.5. The Service Provider reserves the right to modify pricing with at least 30 days’ prior notice to existing subscribers.

6. User Obligations and Acceptable Use

6.1. The User agrees to use the Service only for lawful purposes and in compliance with these Terms.

6.2. The User shall not:

  • Use the Service to generate content that is illegal, defamatory, or infringes third-party rights.
  • Attempt to gain unauthorized access to the Service, other users’ accounts, or the Service’s infrastructure.
  • Use automated tools (bots, scrapers) to interact with the Service outside of the provided API.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Resell or redistribute the Service without written authorization from the Service Provider.

6.3. The User is solely responsible for the content published to their e-commerce store through the Service and for ensuring compliance with applicable regulations in their jurisdiction.

7. Intellectual Property

7.1. The Service, including its design, source code, algorithms, and documentation, is the intellectual property of the Service Provider and is protected by applicable copyright and intellectual property laws.

7.2. AI-generated product descriptions created through the Service are the property of the User. The User receives a full, unrestricted license to use, modify, and publish the generated content.

7.3. The Service Provider retains no ownership rights over the content generated for the User’s products.

7.4. The User grants the Service Provider a limited, non-exclusive license to process the User’s product data solely for the purpose of providing the Service.

8. Liability Limitations

8.1. The Service is provided “as is” and “as available.” The Service Provider makes no warranties regarding the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

8.2. The Service Provider shall not be liable for:

  • Any direct or indirect damages resulting from the use of AI-generated content.
  • Temporary unavailability of the Service due to maintenance, updates, or force majeure.
  • Loss of data resulting from the User’s failure to maintain adequate backups.
  • Actions of third-party services (Stripe, Supabase, OpenAI, Google) that may affect Service availability or functionality.

8.3. The Service Provider’s total liability under these Terms shall not exceed the amount paid by the User for the Service in the 12 months preceding the event giving rise to the claim.

8.4. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence or willful misconduct.

9. Service Modifications and Termination

9.1. The Service Provider reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable prior notice to Users.

9.2. The User may terminate their Account at any time by using the account deletion feature in Settings > Privacy & Data. Account deletion is immediate and irreversible.

9.3. Upon Account termination, all User data is permanently deleted in accordance with the Privacy Policy. Active subscriptions are canceled automatically.

9.4. The Service Provider may terminate a User’s Account immediately upon material breach of these Terms, without prejudice to any other rights or remedies.

10. Consumer Withdrawal Right

10.1. In accordance with the EU Consumer Rights Directive (Directive 2011/83/EU) and Polish law (Act of 30 May 2014 on Consumer Rights), consumers have the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason.

10.2. To exercise the withdrawal right, the consumer must inform the Service Provider of their decision by sending a clear statement to: agencjaautomatyzacji.pl@gmail.com.

10.3. Upon valid withdrawal, the Service Provider will reimburse all payments received from the consumer within 14 days of receiving the withdrawal notification.

10.4. The withdrawal right applies to each billing period of the subscription independently.

11. Governing Law and Dispute Resolution

11.1. These Terms are governed by and construed in accordance with the laws of the Republic of Poland.

11.2. Any disputes arising from or in connection with these Terms shall be resolved by the competent courts of Warsaw, Poland, unless mandatory consumer protection laws provide otherwise.

11.3. Consumers residing in the European Union may also submit disputes to the EU Online Dispute Resolution platform at https://ec.europa.eu/odr.

11.4. Before initiating legal proceedings, the parties agree to attempt to resolve any dispute amicably through direct communication.

12. Final Provisions

12.1. These Terms enter into force on February 26, 2026.

12.2. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3. The Service Provider may amend these Terms by publishing the updated version on the website and notifying Users via email at least 14 days before the changes take effect.

12.4. Continued use of the Service after the effective date of amended Terms constitutes acceptance of the changes.

12.5. Matters not covered by these Terms shall be governed by applicable Polish law and EU regulations.
